A person who is in a Chapter 13 bankruptcy has the absolute right to dismiss his bankruptcy case or convert to Chapter 7 bankruptcy at any time, absent bad faith. A person who is in a Chapter 7 bankruptcy does not have the absolute right to dismiss his case but may usually convert to a bankruptcy case under Chapter 13 of the Bankruptcy Code by filing the appropriate motion with the Bankruptcy Court. There are issues to watch when going from on chapter to another, though. For example, when moving from a Chapter 13 Bankruptcy to a Chapter 7 Bankruptcy, you’ll need to review whether you have acquired items that will now be considered property of the estate under Chapter 7 Bankruptcy that wasn't part of the previous filing.
